By using the Cloudfood Photo app ("the App"), you agree to these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Description of Service

Cloudfood Photo is a creative tool that helps restaurants produce high-quality, brand-consistent photo packs for social media and marketing. The App provides features that assist you in generating, organizing, and exporting restaurant photo collections in a simple and efficient way.

2. User Accounts

Certain features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your login information and for all activities performed under your account. You agree to provide accurate, up-to-date information when creating or updating your account.

3. User Content

"User Content" refers to any images, text, branding, or other materials you upload or create within the App.

• You retain full ownership of your User Content.
• By using the App, you grant Cloudfood Photo a non-exclusive, worldwide, royalty-free license to process, store, and display your content solely for the purpose of operating, maintaining, and improving the App's features.
• You agree not to upload or create content that is illegal, harmful, misleading, or infringes on the rights of others.

Cloudfood Photo does not claim ownership over your restaurant photography, brand logos, or any materials you provide.

4. Intellectual Property

All technology, design, features, and content within the App — including software, algorithms, interface elements, and assets — are the property of Cloudfood Photo and its licensors.

You may not:

• Copy, distribute, or modify any part of the App.
• Reverse engineer, decompile, or attempt to extract the source code.
• Use any part of the App for purposes outside those permitted by these Terms.

5. Prohibited Conduct

You agree not to use the App for any unlawful or unauthorized purpose. This includes, but is not limited to:

• Uploading or generating content that is defamatory, obscene, discriminatory, or violates intellectual property rights.
• Attempting to bypass, interfere with, or disrupt the App's security, infrastructure, or technical processes.
• Using automated scripts or unauthorized tools to access the App.

6. Termination

Cloudfood Photo may suspend or terminate your access to the App at any time, without notice, if:

• You violate these Terms.
• Your actions pose a risk to other users or the stability of the App.
• Required by law or by operational necessity.

Upon termination, your access will be disabled but your User Content may be retained as required for legal or operational purposes.

7. Disclaimers

The App is provided "as is" and "as available."

Cloudfood Photo makes no warranties, expressed or implied, regarding:

• The App's availability, performance, or error-free operation.
• The suitability of the generated photo outputs for any specific business purpose.

You use the App at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, Cloudfood Photo shall not be liable for:

• Any indirect, incidental, special, or consequential damages.
• Loss of data, revenue, or business opportunities arising from your use of the App.
• Any issues resulting from User Content or third-party services connected to the App.

9. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Vietnam, without regard to its conflict-of-law principles.

10. Changes to Terms

Cloudfood Photo reserves the right to modify or update these Terms at any time. Any changes will take effect immediately upon posting within the App or on the official Cloudfood website. Your continued use of the App after changes are published signifies your acceptance of the updated Terms.
